RTM & RMC DIRECTOR SUPPORT
Being a director of an RTM or RMC carries legal and financial responsibility. Our role is to support directors in understanding those responsibilities, meeting their obligations and making informed decisions, without being overwhelmed by technical detail or unnecessary complexity.

Both RTMs and RMCs are companies set up to give leaseholders control over how their building is managed, but they are created in different ways, have different legal foundations, and operate slightly differently in practice.
Right to Manage (RTM)
An RTM company is created under the Commonhold and Leasehold Reform Act 2002.
Its purpose is to allow leaseholders to take over the management of the building from the freeholder, without having to prove fault or buy the freehold.

Leaseholders must formally claim the right to manage
The process is statutory and procedural
Management transfers by law on a set date
The freeholder remains the owner, but loses management control
Directors take on immediate legal and compliance responsibility
RTM is often chosen when leaseholders are unhappy with the existing managing agent or freeholder-led management.

Resident Management Company (RMC)
An RMC is usually set up by the developer when a building is first constructed.
Leaseholders become members of the company automatically through their lease, and the company is responsible for managing the building (often via a managing agent).
Key points:
Management rights are written into the lease
No statutory claim process is required
The RMC exists from the outset
Directors manage the building on behalf of leaseholders
The freeholder may still have some retained rights, depending on the lease
RMCs are common in modern developments and purpose-built blocks.

RTMs require careful handling around handover, compliance catch-up and governance.
RMCs require consistent support around decision-making, administration and long-term planning.
